Terms of Service

These Terms of Service apply to the public release of the Wika PH mobile application and wikaph.com.

In plain terms

Wika teaches Philippine regional languages. Most of it is free. WIKA Student, WIKA Pro, and WIKA Premium are optional auto-renewing subscriptions billed by Apple, which you cancel through Apple, not through us. Dialecto is an AI partner: it sends what you write to Google to generate a reply, and only with your explicit permission. Its answers can be wrong. Your content stays yours and is not used to train models. You can delete your account from inside the app at any time. This summary is for orientation only — the numbered sections below are the agreement.

"App Store"Apple's App Store, through which the iOS application is distributed.

01This agreement

1.1

These Terms of Service ("Terms") form a binding agreement between you and Wika governing your use of the Service.

1.2

By downloading, installing, creating an account, or otherwise using the Service, you accept these Terms. If you do not accept them, do not use the Service.

1.3 Incorporated document

These Terms include, and you also agree to, the Privacy Policy (wikaph.com/privacy), which governs what data we collect and who processes it. What you may not do with the Service is set out in §7 of these Terms, and the subscription bargain in §6; neither is a separate agreement.

1.4 Order of precedence

On personal data, the Privacy Policy controls. On the mechanics of a purchase, Apple's own terms control where they conflict with ours. On everything else, these Terms control.

1.5 Beta participants

If you joined through TestFlight, separate beta terms governed that participation. Those terms ceased to apply when the Service was publicly released, and these Terms replaced them for every account — see §16.4.

02Who may use the Service

2.1 Minimum age

You must be at least 13 years old to use the Service.

2.2 Under 18

If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the knowledge and consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Service, including any purchase.

2.3 Under 13

The Service is not directed to children under 13 and we do not knowingly collect their personal data. If we learn that we hold personal data of a child under 13, we delete it. A parent or guardian who believes we hold such data should write to marketing@wikaph.com, and we will act on it. See Privacy Policy §9.

2.4 Accounts

You are responsible for the accuracy of your registration details and for activity under your account. Keep your credentials secure and tell us promptly at marketing@wikaph.com if you believe your account has been accessed without your permission.

2.5

Accounts are personal. One account per person; do not sell, share, or transfer an account.

2.6 Where the Service is available

We may limit availability by territory. You are responsible for compliance with the laws that apply where you are.

03Licence to use the Service

3.1

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Service for your own language learning.

3.2

For the iOS application, this licence is subject to the Usage Rules in the Apple Media Services Terms and Conditions, and permits use on any Apple device you own or control. See §14.

3.3

No other rights are granted. Anything not expressly permitted is reserved.

04What the Service does, and what it does not promise

4.1

Wika teaches Philippine regional languages — including Tagalog, Cebuano, Ilocano, Hiligaynon, and Asi — through lessons, exercises, a dictionary, and Dialecto.

4.2 Language content is educational, not authoritative

Philippine regional languages vary by province, municipality, and speaker, and reasonable native speakers disagree about usage. Translations, example sentences, and pronunciation guidance reflect common usage as we understand it. They are not a standard endorsed by any government body, academic institution, or language commission. Do not rely on the Service for legal, medical, official, employment, immigration, or other consequential translation. Engage a qualified human translator for that.

4.3 Dialecto output is generated by an AI model and can be wrong

It may produce inaccurate translations, invented words, incorrect grammar, or culturally inappropriate phrasing. It is labelled as AI-generated in the app and every reply carries a report control. Treat its output as practice material. Nothing Dialecto says is advice of any kind, and it does not speak for Wika.

4.4 Availability

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We may perform maintenance, and we may impose fair usage limits on resource-intensive features such as Dialecto.

4.5 Changes to the Service

We may add, change, suspend, or remove features. Where a change materially reduces a benefit you have paid for, §6.9 applies.

05Content

5.1 Your Content stays yours

You retain all rights you have in your Content.

5.2 The licence you give us

You grant Wika a non-exclusive, worldwide, royalty-free, sublicensable-only-to-our-processors licence to host, store, reproduce, transmit, adapt, and display your Content solely to operate and support the Service for you. That includes transmitting it to the processors named in Privacy Policy §4 so Dialecto can reply, and to our infrastructure providers so it can be stored. The licence exists only for those purposes, and it ends when the Content is deleted, subject to the retention periods in Privacy Policy §7 and to §5.4 below.

5.3 We do not train models on your Content

Your messages and recordings are used to produce the response you asked for and to operate the Service. They are not used to train Wika's own models. The third-party processors that receive your Content, and what each of them receives, are named in Privacy Policy §4 and §5A; each handles what it receives under its own terms, which may permit it to retain that content for its own abuse monitoring.

5.4 Aggregated and anonymised data

We may derive statistical and anonymised information from usage — for example how many learners complete a lesson, or which exercises are most often failed — and use it to improve the Service and describe it publicly. Such data does not identify you and cannot reasonably be used to re-identify you. This survives deletion of your Content.

5.5 Our content

Lessons, courses, audio, illustrations, the mascot, the Wika name and logo, the software, and the arrangement and selection of all of it are owned by Wika or its licensors and are protected by copyright, trade mark, and other laws. You may not copy, scrape, mirror, redistribute, publicly perform, sell, sublicense, or create derivative works from them, and you may not use automated means to extract course content, audio, or dictionary data in bulk.

5.6 Feedback

If you send us a suggestion, bug report, or idea, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use it without obligation, attribution, or payment. Where a specific bug bounty programme applies, that programme's own terms govern any reward. Do not send us anything you consider confidential.

5.7 Content standards

You are responsible for your Content and warrant that you have the rights necessary to submit it and that it does not breach the acceptable use rules in §7.

07Acceptable use

7.1 The short version

Use Wika to learn a language. Do not use it to harm anyone, to break the app, or to cheat the economy. The rest of this section says what that means, and forms part of these Terms. The same rules are published on their own at wikaph.com/acceptable-use; where the two differ, this section controls.

7.2 Do not misuse Dialecto

Dialecto is a language-practice partner. You may not use it, or any other part of the Service, to generate, request, or distribute:

  • Sexual content involving minors, in any form, in any language, under any framing. This is the one item on this page with no context that excuses it. Accounts are terminated immediately and without notice, and reports are made to the authorities where the law requires it.
  • Content that sexually exploits or abuses any person.
  • Threats of violence, incitement to violence, or content that promotes or celebrates it.
  • Harassment or abuse directed at a real, identifiable person.
  • Content that promotes hatred against people on the basis of ethnicity, region, religion, sex, gender, sexual orientation, disability, or any comparable characteristic. Regional and linguistic identity is explicitly included — an app for Philippine regional languages will not be a vehicle for contempt between the communities that speak them.
  • Instructions for producing weapons, explosives, or illegal drugs.
  • Material that infringes somebody else's copyright or trade mark.
  • Deliberate attempts to make the model produce any of the above, including by role-play framing, translation framing, or instructions to disregard its guidelines.

Asking Dialecto how to say a rude word, or a frank word about the body, in Cebuano is not a breach of this section. Languages contain such words, learners ask about them, and pretending otherwise makes for a worse teacher. The line is harm to a person, not vocabulary.

7.3 Do not abuse the Service

You may not:

  • Reverse-engineer, decompile, or attempt to extract source code or model prompts from the app, except to the extent that applicable law expressly permits it despite this restriction.
  • Access the Service through anything other than the official app — no scripted clients, no automated agents, no scraping of course content, audio, or dictionary data in bulk.
  • Probe, scan, or test the security of our systems, or attempt to reach data belonging to another account. Good-faith security research is welcome — report it to marketing@wikaph.com first, and we will not pursue you for testing conducted within the scope we agree.
  • Deliberately overload the Service or interfere with another person's use of it.
  • Circumvent rate limits, usage quotas, or the entitlement system.

7.4 Do not cheat the economy

Hearts, gold, streaks, XP, and rank exist to make practice rewarding. You may not:

  • Modify the app, its stored data, or its network traffic to award yourself currency, hearts, XP, or entitlements.
  • Exploit a bug to obtain items or progress you did not earn. Finding one is fine — and if you report it, the bug bounty may pay you. Farming it is not.
  • Sell, buy, or transfer accounts or in-app items.
  • Operate multiple accounts to game leaderboards, leagues, or referral rewards.

We may reverse ill-gotten balances and reset affected progress without compensation. Where the cause was our own bug and you did not exploit it deliberately, we will not penalise you.

7.5 Do not misrepresent yourself

You may not impersonate another person, claim affiliation with Wika that you do not have, or register an account using somebody else's identity or payment method.

7.6 What happens if you breach this section

Depending on what happened and whether it looks deliberate, we may: remove content, reverse a balance, restrict a feature, suspend the account, or terminate it under §9.2.

Except where the breach is serious, repeated, or where telling you would be unlawful or would defeat the purpose of the action, we will tell you what happened and give you a way to respond. An account action you cannot ask about is an account action you cannot correct, and we get these wrong sometimes.

Appeal to the address below. Include the account email and what you think happened.

7.7 Reporting

  • Report a Dialecto replyuse the report control on the response itself. That attaches the exact exchange, which a description cannot.
  • Report anything else, or appeal an action — wikaph.com/contact, or Settings › About › Contact support in the app.
  • Report a security issue — marketing@wikaph.com, with "security" in the subject.

08Third-party services

8.1

The Service depends on third parties — including Apple, Google, our AI and speech processors, and our infrastructure and payment providers. They are named, with what each receives and why, in the Privacy Policy §4.

8.2

Your use of a third-party service through the Service may also be governed by that party's own terms. We are not responsible for third-party services we do not control, and their availability may change.

8.3

The Service may link to third-party websites. We do not endorse them and are not responsible for their content.

09Suspension, termination, and deletion

9.1 By you

You may stop using the Service at any time and delete your account from inside the app at Settings › Privacy & AI › Delete account, or from the Account card on your Profile. Deletion is immediate and permanent, removes your learning history, and forfeits Virtual Items and any remaining subscription time. It does not cancel an auto-renewing subscription — cancel that through Apple first, per §6.4. What deletion removes is set out in the app before you confirm, and in Privacy Policy §7.

9.2 By us

We may suspend or terminate your access where:

  • you materially breach these Terms, including the acceptable use rules in §7;
  • we are required to by law, or by Apple;
  • your use poses a security or legal risk to other users, to third parties, or to the Service; or
  • we discontinue the Service (§9.4).

9.3 Notice and appeal

Except where the breach is serious or repeated, where the law forbids it, or where notice would defeat the purpose of the action, we will tell you what happened and give you a way to respond. Appeal to marketing@wikaph.com with the account email and what you think occurred. We get these wrong sometimes, and an account action you cannot ask about is one you cannot have corrected.

9.4 Discontinuing the Service

If we discontinue the Service or a paid tier, we will give at least 30 days' notice where reasonably possible, stop new and renewing charges, and provide a way to export your learning data.

9.5 Effect of termination

Your licence under §3 ends immediately. Sections 0, 5.2 (as to Content already processed), 5.4, 5.5, 5.6, 6.7, 10, 11, 12, 13, 15 and 17 survive.

10Disclaimers

10.1

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.

10.2

We do not warrant that the Service will meet your requirements, that language content or Dialecto output will be accurate or complete, or that the Service will be available without interruption.

10.3

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any non-waivable right under the Consumer Act of the Philippines or the consumer law where you live.

11Limitation of liability

To the fullest extent permitted by law, and subject always to §10.3:

11.1

Wika is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or anticipated savings, however caused.

11.2

Wika's total aggregate liability arising out of or relating to these Terms or the Service is limited to the total amount you paid Wika in the twelve months immediately before the event giving rise to the claim. No minimum floor is stated: until counsel sets one, the cap is what you actually paid, and §10.3 continues to override this limit wherever the law does not permit it.

11.3

These limitations apply regardless of the theory of liability and even if a limited remedy fails of its essential purpose.

11.4

Some jurisdictions do not permit some of these exclusions; where that is so, they apply only to the extent permitted, and the remainder stands.

12Indemnity

You will indemnify and hold harmless Wika and its officers, employees, and contractors against third-party claims, damages, losses, and reasonable legal costs arising from (a) your breach of these Terms, including the acceptable use rules in §7, or (b) Content you submit. This does not apply to the extent the claim arises from Wika's own act or omission, and we will notify you of any claim we ask you to indemnify and not settle it without your consent, such consent not to be unreasonably withheld.

13Intellectual property complaints

If you believe material in the Service infringes your copyright or trade mark, write to marketing@wikaph.com with:

  • identification of the work you say is infringed;
  • identification of the material in the Service and where to find it;
  • your contact details;
  • a statement that you believe in good faith that the use is not authorised by the rights holder or the law;
  • a statement that the information is accurate and that you are the rights holder or authorised to act for them.

We will investigate and, where appropriate, remove or disable the material. We may pass your notice to the person who submitted the material. We terminate the accounts of repeat infringers. This process operates alongside your rights under the Intellectual Property Code of the Philippines (RA 8293) and does not limit them.

14Apple-specific terms

This section is required because the iOS application is distributed through the App Store, and applies only to that application. In the event of a conflict, this section prevails over the rest of these Terms as to the matters it covers.

14.1

These Terms are between you and Wika only, not with Apple. Apple is not responsible for the application or its content.

14.2

Your licence is as described in §3.2 and is subject to Apple's Usage Rules.

14.3

Apple has no obligation to furnish maintenance or support for the application.

14.4

If the application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Wika's responsibility.

14.5

Apple is not responsible for addressing any claim by you or a third party relating to the application or your possession or use of it, including product liability claims, any claim that the application fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

14.6

Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party claim that the application infringes intellectual property rights.

14.7

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

14.8

You must comply with any applicable third-party terms when using the application.

14.9

Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you as a third-party beneficiary. Save for Apple, no person who is not a party has any right to enforce these Terms.

15Governing law and disputes

15.1 Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law principles.

15.2 Talk to us first

Before commencing proceedings, contact marketing@wikaph.com and give us 30 days to resolve the matter. Most disputes are a misunderstanding that a reply resolves.

15.3 Venue

Disputes not resolved under §15.2 are subject to the exclusive jurisdiction of the courts of the Republic of the Philippines. No single city or province is named; where the law gives a consumer a choice of venue, that choice is unaffected by this section.

15.4 Your local rights

If you are a consumer resident outside the Philippines, nothing in §15.1 or §15.3 deprives you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings there.

15.5 Time limit

Any claim must be brought within one year after it arises, or within the minimum period the applicable law permits if that is longer.

16Changes to these Terms

16.1

We may update these Terms. The Effective date and Version at the top change with each revision.

16.2 Material changes

Where a change is material, we will give notice in the app, and where we hold a verified email address, by email, at least 14 days before it takes effect — except where a change must take effect sooner to comply with law or to address a security risk.

16.3

Continuing to use the Service after a change takes effect means you accept the revised Terms. If you do not accept them, stop using the Service and, if you wish, delete your account under §9.1. If a material change disadvantages you and you cancel a paid subscription because of it, §6.9 applies.

16.4 Beta transition

On public release these Terms replaced the beta terms that governed the TestFlight programme, for all users. The provision in those beta terms permitting learning progress, streaks, and wallet balances to be reset without notice did not survive into these Terms, and does not apply to any account. Beta participants kept their progress into the public release, subject to §4.4 and §9.

Every purpose above reaches the same inbox, which is the one Wika operates and reads. Put the subject line shown beside it and it is routed to the right person.

17.3 Operating entity

The Service is currently operated by Wika PH as an unincorporated undertaking. On incorporation, these Terms and all rights and obligations under them transfer to the incorporated entity by operation of §18.4, and we will publish the entity's registered name and address in this section and give notice under §16.2.

18General

18.1 Severability

If a provision is held invalid or unenforceable, it is modified to the minimum extent necessary to make it enforceable, or severed if it cannot be; the rest remains in force.

18.2 No waiver

A failure or delay in enforcing a provision is not a waiver of it.

18.3 Entire agreement

These Terms, with the document incorporated by §1.3, are the entire agreement between you and Wika about the Service and supersede prior agreements on that subject, including the beta terms that governed the TestFlight programme, per §16.4.

18.4 Assignment

You may not assign or transfer these Terms. We may assign them to a successor in connection with a merger, acquisition, reorganisation, or incorporation of the Wika undertaking, on notice to you; your rights under these Terms are unaffected by such an assignment.

18.5 Force majeure

Neither party is liable for failure to perform caused by events beyond its reasonable control — including natural disaster, typhoon, earthquake, epidemic, war, civil unrest, government action, and failure of telecommunications or a third-party provider. This does not excuse an obligation to pay, or to refund where a refund is due.

18.6 Relationship

These Terms create no partnership, agency, employment, or joint venture.

18.7 Language

These Terms are written in English. A translation is provided for convenience only; the English version governs.

18.8 Headings

Headings and the summary at the top are for convenience and do not affect interpretation.
